Text         Administration on Road Traffic Safety

    According to the Law of the People’s Republic of China on Road Traffic Safety, the task of traffic police is to maintain the road traffic order, prevent and reduce traffic accidents, protect the personal safety, the safety of properties and other legal interests of citizens, legal persons and other organizations, and to keep the road clear.
 
The department of the public security organ and its traffic policemen shall be in charge of all roads, motor vehicles, non-motor vehicles, vehicle drivers, pedestrians, passengers, road traffic activity-related entities and individuals according to law.
The department of the public security organ and its traffic policemen shall timely correct the illegal acts on road traffic safety.
The traffic administrative department of the public security organ and its traffic policemen shall, on the basis of the facts and in accordance with the relevant provisions of the present Law, impose penalties upon the illegal acts on road traffic safety, or shall point out the illegal acts whose circumstances are too minor to affect the road passage, and impose an oral warning before release.
The categories of the penalties against illegal acts on road traffic safety include: warning, fine, temporary seizure or revocation of the motor vehicle driving license, and detention.
Where a pedestrian, passenger or non-motor vehicle driver violates any of the provisions in the road traffic safety laws or regulations on road passage, he shall have imposed a warning or a fine of 5 yuan up to 50 yuan; if the non-motor vehicle driver refuses to accept the penalty of fine, his non-motor vehicle may be detained.
Where a motor vehicle driver violates any of the provisions in the road traffic safety laws or regulations on road passage, he shall have imposed a warning or a fine of 20 yuan or up to 200 yuan.
Whoever drives a motor vehicle after drinking alcohol shall have imposed the penalty of temporary seizure of his motor vehicle driving license for not less than 1 month but not more than 3 months, and have imposed a fine of not less than 200 yuan, but not more than 500 yuan as well; whoever drives a motor vehicle when he is drunk shall be restricted by the traffic administrative department of the public security organ until he becomes sober, be detained for not more than 15 days, have imposed the penalty of temporary seizure of his motor vehicle driving license for not less than 3 months but not more than 6 months, and have imposed a fine of not less than 500 yuan, but not more than 2000 yuan as well.
Where anyone forges, alters or uses forged or altered motor vehicle registration certificate, plate, driving permit, conformity inspection mark, insurance sign or driving license or uses the motor vehicle registration certificate, plate, driving permit, conformity inspection mark or insurance sign of any other vehicle, they shall have their motor vehicles confiscated and be detained by the traffic administrative department of the public security organ, and a fine of not less than 200 yuan but not more than 2000 yuan shall be imposed; if a crime is constituted, he shall be subject to criminal liabilities in accordance with the law.
Whoever has any of the following acts shall have imposed a fine of not less than 200 yuan but not more than 2000 yuan by the traffic administrative department of the public security organ:
1. Driving a motor vehicle without obtaining the motor vehicle driving license, or when his motor vehicle driving license is revoked, or during the period when his motor vehicle driving license is temporarily seized;
2. Delivering a motor vehicle to be driven by a person who has no motor vehicle driving license or whose motor vehicle driving license is revoked or temporarily seized;
3. Fleeing away from the scene after causing a traffic accident, with no crime being constituted;
4. Driving a motor vehicle exceeding the prescribed speed per hour by 50%;
5. Forcing a motor vehicle driver to violate the road traffic safety laws or regulations or the requirements on safe driving of motor vehicles to drive a motor vehicle, thus causing a traffic accident, but no crime is constituted;
6. Violating the provisions on traffic control to pass by force, without listening to the dissuasion;
7. Intentionally damaging, moving or altering traffic facilities, causing endangering consequences, but no crime is constituted;
8. Illegally hold up or detain a motor vehicle, without listening to the dissuasion, thus causing a serious traffic jam or heavy property losses.
Whoever violates the road traffic safety laws or regulations, thus causing a heavy traffic accident shall, if a crime is constituted, be subject to criminal liabilities in accordance with the law, and his motor vehicle driving license shall be revoked by the traffic administrative department of the public security organ.
When fleeing from the scene after causing a traffic accident, his motor vehicle driving license shall be revoked by the traffic administrative department of the public security organ, and he may not re-apply for a motor vehicle driving license during his lifetime.
When imposing a warning or a fine of not more than 200 yuan upon a road traffic law violator, the traffic policeman may make a decision on an administrative penalty on the spot, and issue a written decision on the administrative penalty.
A written decision on the administrative penalty shall state the fact on the party's violation of law, the basis of the administrative penalty, the contents of the penalty, the time, the place, and the name of the penalizing organ, which shall be signed or affixed with a seal by the law enforcement officials.
Where the traffic administrative department of the public security organ seizes temporarily or revokes a motor vehicle driving license, it shall issue a written decision on the administrative penalty.
 
 
道路交通安全管理
交警的工作就是根据中华人民共和国道路交通安全法的规定,维护道路交通秩序,预防和减少交通事故,保护人身安全,保护公民、法人和其他组织的财产安全及其他合法权益,提高道路通行效率。
 
公安机关交通管理部门及其交通警察依法对道路、机动车、非机动车、车辆驾驶人、行人、乘车人以及与道路交通活动有关的单位和个人进行管理。
公安机关交通管理部门及其交通警察对道路交通安全违法行为,应当及时纠正。
公安机关交通管理部门及其交通警察应当依据事实和本法的有关规定对道路交通安全违法行为予以处罚。对于情节轻微,未影响道路通行的,指出违法行为,给予口头警告后放行。
对道路交通安全违法行为的处罚种类包括:警告、罚款、暂扣或者吊销机动车驾驶证、拘留。
行人、乘车人、非机动车驾驶人违反道路交通安全法律、法规关于道路通行规定的,处警告或者五元以上五十元以下罚款;非机动车驾驶人拒绝接受罚款处罚的,可以扣留其非机动车。
机动车驾驶人违反道路交通安全法律、法规关于道路通行规定的,处警告或者二十元以上二百元以下罚款。
饮酒后驾驶机动车的,处暂扣一个月以上三个月以下机动车驾驶证,并处二百元以上五百元以下罚款;醉酒后驾驶机动车的,由公安机关交通管理部门约束至酒醒,处十五日以下拘留和暂扣三个月以上六个月以下机动车驾驶证,并处五百元以上二千元以下罚款。
伪造、变造或者使用伪造、变造的机动车登记证书、号牌、行驶证、检验合格标志、保险标志、驾驶证或者使用其他车辆的机动车登记证书、号牌、行驶证、检验合格标志、保险标志的,由公安机关交通管理部门予以收缴,扣留该机动车,并处二百元以上二千元以下罚款;构成犯罪的,依法追究刑事责任。
有下列行为之一的,由公安机关交通管理部门处二百元以上二千元以下罚款:
(一)未取得机动车驾驶证、机动车驾驶证被吊销或者机动车驾驶证被暂扣期间驾驶机动车的;
(二)将机动车交由未取得机动车驾驶证或者机动车驾驶证被吊销、暂扣的人驾驶的;
(三)造成交通事故后逃逸,尚不构成犯罪的;
(四)机动车行驶超过规定时速百分之五十的;
(五)强迫机动车驾驶人违反道路交通安全法律、法规和机动车安全驾驶要求驾驶机动车,造成交通事故,尚不构成犯罪的;
(六)违反交通管制的规定强行通行,不听劝阻的;
(七)故意损毁、移动、涂改交通设施,造成危害后果,尚不构成犯罪的;
(八)非法拦截、扣留机动车辆,不听劝阻,造成交通严重阻塞或者较大财产损失的。
违反道路交通安全法律、法规的规定,发生重大交通事故,构成犯罪的,依法追究刑事责任,并由公安机关交通管理部门吊销机动车驾驶证。
造成交通事故后逃逸的,由公安机关交通管理部门吊销机动车驾驶证,且终生不得重新取得机动车驾驶证。
对道路交通违法行为人予以警告、二百元以下罚款,交通警察可以当场作出行政处罚决定,并出具行政处罚决定书。
行政处罚决定书应当载明当事人的违法事实、行政处罚的依据、处罚内容、时间、地点以及处罚机关名称,并由执法人员签名或者盖章。
公安机关交通管理部门暂扣或者吊销机动车驾驶证的,应当出具行政处罚决定书。

Text     Administration of the Entry and Exit of Aliens
 
Administration of The Entry and Exit of Aliens is an important task of China’s Public Security Bureau in managing public orders and social security. It mainly involves the administration of aliens’ affairs such as entry, inspection of entry and exit certificates, residence, accommodation registration, travel and exit.

I. Entry

For entry to China, aliens shall apply for visas to Chinese diplomatic missions, consular posts or other foreign-based agencies authorized by the Ministry of Foreign Affairs of the People’s Republic of China.
Aliens holding letters or telegrams from authorized organizations of China and ordinary passports issued by countries that have diplomatic relations or official trade contacts with China may apply for visas to port visa agencies authorized by the Ministry of Public Security in case of an urgent need to travel to China and a lack of time to apply for visas to the above –mentioned Chinese agencies abroad. When applying for visas, aliens shall provide such pertinent information as requested and complete the following procedures:
1.Present valid passports of replacement certificate.
2. Fill in visa application forms and submit recently taken two- inch, half- length, bare- headed and full- faced photos.
3. Submit for examination papers supporting the application for entry into or transit through China.
II. Inspection of Entry and Exit Certificates
Upon arrival at a Chinese port, aliens shall submit their valid passports, Chinese visas and certificates to border check posts for examination and shall fill in entry and exit forms. They may enter China after the border check post completes inspection and affixes inspection seals.
Aliens and their means of transport required by the visa agencies to pass through designated ports shall only enter or depart through these ports. For exit, aliens shall submit for examination their valid passports or other valid certificates as well as visas or residence certificates permitting their stay in China.
III. Residence
Aliens holding visas D, Z or X shall within 10 days of entry in China, obtain aliens’ residence cards or aliens’ temporary residence cards from the city or county Public Security Bureau at the place of their residence. The period of validity of the certificates is the duration of holders’ permitted stay in China. Aliens’ residence cards are issued to those who stay in China for one year or more. Aliens’ temporary residence cards are issued to those who stay less than one year in China. Aliens holding visas F, L, G or C may stay in China for the period prescribed on their visa without obtaining residence certificates.
 In applying for residence certificates, aliens shall provide such information as requested and complete the following procedures:
1. Submit for examination their passports, visas and papers supporting their purpose for residence.
2. Fill in residence application forms.
3. In applying for aliens’ residence cards, submit for examination health certificates and recently-taken, two-inch, bare-headed, full-faced photos.
IV. Accommodation Registration
For lodging at guesthouse, inn, hotel, school or other enterprises and institutions or at government organs or other Chinese organizations, aliens shall present valid passports or residence certificates and fill in registration forms of temporary accommodation. They shall present travel permits when seeking accommodation in areas closed to aliens.
When an alien wishes to lodge at the home of a Chinese resident in urban areas, the host or the lodger shall within 24 hours of the lodger’s arrival, report to the local Public Security Bureau with the lodger’s passport and certificate as well as the host’s residence booklet and fill in registration forms of temporary accommodation. In rural areas, the host or the lodger shall report to local police station or residence registration office within 72 hours of the lodger’s arrival.
When an alien lodges at a foreign institution in China or at the home of an alien in China, the institution in question or the host or the lodger shall within 24 hours of lodger’s arrival, report to the local Public Security Bureau with the lodger’ s passport of residence certificate and fill in registration forms of temporary accommodation.
V. Travel
An alien wishing to travel to cities or counties closed to aliens shall apply in advance for a travel permit to the Public Security Bureau of the city or county where he or she stays and may proceed there only with permission. To apply for a travel permit, the following procedures must be completed:
1. Submit passport or residence certificate for examination.
2. Provide papers supporting the purposes of travel.
3. Fill in a travel application form.
VI. Exit
Aliens shall leave China in the time limit prescribed on the visas or within the period of validity of their residence certificate.
An alien holding a residence certificate who does not wish to return to China after exit shall hand in his or her residence certificate for cancellation to the border check post upon exit.
 
外事管理不仅是中国公安部门的一项重要任务,同时也是维护社会治安和秩序的一个重要步骤。它主要针对对外国人的各项事务进行管理,包括入境、出入境证件检查、居住、住宿登记、旅行、出境等手续。
  
一、入境
外国人入境,应当向中国的外交代表机关、领事机关或者外交授权的其他驻外机关申请办理签证。
外国人持有中国国内被授权单位的函电,并持有与中国有外交关系或官方贸易往来国家的普通护照在因紧急情况来不及向中国驻外机构申办签证的,可以向公安部授权的口岸签证机关申请办理签证。在申请签证时,外国人必须回答被询问的有关情况并履行下列手续:
1、 提供有效护照或者能够代替护照的证件。
2、 填写签证申请表,交近期2寸半身正面免冠照片。
3、 交验与申请入境、过境事由有关的证件。
 
二、出入境证件检查
     外国人抵达口岸,必须向边防检查站交验有效护照和中国的签证、证件,填写出入境卡,经边防检查站查验核对加盖验章后入境。
被签证机关指定通行口岸的外国人和外国人的交通工具,必须从指定的口岸入、出境。外国人出境,必须交验有效护照或者其他有效证件,以及准予在中国停留的签证或者居留证件。
 
三、持有D、Z、X字签证的外国人,必须自入境之日起十日内到居住地市、县公安局办理外国人居留证或外国人临时居留证。上述居留证件的有效期为准许持证人在中国居留的期限。外国人居留证,发给在中国居留一年以上的人员。外国人临时居留证,发给在中国居住不满一年的人员。持有F、L、G、C字签证的外国人,可以在签证证明的期限内在中国停留,不需办理居留证件。
外国人申请居留证必须回答被询问的有关情况并履行下列手续:
1、   交验护照、签证和与居留事宜有关的证明。
2、   填写居留申请表。
3、   申请外国人居留证的,要交验健康证明书,交近期二寸半身正面免冠照片。
 
四、住宿登记
     外国人在宾馆、饭店、旅店、招待所、学校等企业、事业单位或者机关、团体及其他中国机构内住宿,应当出示有效护照或者居留证件,并填写临时住宿登记表。在非开放地区住宿还要出示旅行证。
     外国人在中国居民家中住宿,在城镇的,必须于抵达后24小时内,由留宿人或本人持住宿人的护照、证件和留宿人的户口到当地公安机关申报,填写临时住宿登记表;在农村的,必须72小时内向当地派出所或者户籍办公室申报。
外国人在中国的外国机构内或者在中国的外国人家中住宿,必须于住宿人抵达后24小时内,由留宿机构、留宿人或者本人持住宿人的护照或者居留证件,向当地公安机关申报,并填写临时住宿登记表。
 
五、旅行
外国人前往不对外国人开放的市县旅行,必须事先向所在市县公安局申请旅行证,获准后方可前往。申请旅行证必须办理以下手续:
1、   交验护照或居留证件。
2、   提供与旅行事由有关的证明。
3、   填写旅行申请表。
 
六、出境
外国人应当在签证准予停留的期限内或者居留证的有效期内出境。
持有居留证的外国人出境后不再返回中国的,出境时应向边防检查站缴销居留证件。

Text           Narcotics Control in China
 
Narcotic drugs refer to those drugs that may cause dependence and addiction after continuous administration,including opium, heroin, methamphetamine (“ice”), morphine, marijuana, cocaine, other narcotic drugs and psychotropic drugs controlled by the state regulations. Generally speaking, the drug has the following common characteristics:
1. There is an irresistible force making the user continuously take the drug, and to obtain it unscrupulously
 2. Those who continuously take the drug tend to increase the dosage
3. The user has both mental and physical dependence on the drug, and there are some symptoms when the drug addicts stops taking it
4. Drug taking does harm to the user, family, and society as well
 
Drugs harm people's health, give rise to corruption and crimes, disrupt sustainable development, and endanger national security and world peace. Therefore, all illegal activities involving drugs must be strictly prohibited and eliminated. In old China, drugs once brought hideous disaster to the nation. After the founding of the People's Republic of China (PRC) in 1949, the Chinese government led the Chinese people in a momentous struggle against drugs. In a short period of three years, China wiped out the scourge of opium, which had scourged China for a century, thus performing a miracle acknowledged by the whole world. Confronting the new drug problem, the Chinese government, taking an attitude of supreme responsibility to the state, the nation, the people, and mankind as a whole, and standing firm in strictly prohibiting illegal drugs, has adopted all necessary measures and done its utmost to ban illicit drugs for the benefit of the people.
 
For many years, the Chinese government has taken drug control as a fundamental objective, and has formulated and implemented a series of principles, policies and measures in this regard. While prohibiting drug abuse, trafficking, cultivating and manufacturing, we lay equal stress on the control of illicit supplies and the prevention of drug abuse, forbid and crack down on all illegal activities involving drugs. From 1991 to 1999, China's drug-control organs cracked more than 800,000 drug cases, and confiscated 39.67 tons of heroin, 16.894 tons of opium, 15.079 tons of marijuana and 23.375 tons of methamphetamine. However, the drug situation in China remains quite severe due to the rapid increase of drug sources, multi way of drug abuses, and the integration trend of drugmaking, trafficking and abuse. There has been a trend for illegal drug production and trafficking to move from the eastern coastal areas to the inner regions of China and to overseas. In recent years, the sale and abuse of new types of drugs, such as ice and ecstasy, has been increasingly evident in many entertainment venues.
 
The key to drug control work lies in arousing the consciousness of the general public. China regards it as a fundamental and strategic task to raise the consciousness of the whole nation concerning the fight against drugs, and carries out extensive and deep-going drug prevention education among all the people. China had 791,000 drug addicts at the end of 2004, people under 35 years old making up more than 70 percent, according to the National Narcotics Control Commission. Youngsters are now becoming victims of new types of drugs like head-shaking pills, ice, and ketamine powder. We take the prevention of drug abuse by teenagers as a basic project in drug control. As for teenagers, we put stress on education and protection, adopt various powerful measures, organize and coordinate relevant government departments and various mass organizations to perfect the preventive work, and educate youngsters to treasure their lives and refuse drugs. There are professional anti-drug courses in the education plan for students from 11 to 17 years old.
 
Yunnan province is a major route for drugs smuggled out of Southeast Asia’s Golden Triangle, one of the world’s major sources of drugs, located where the borders of Thailand, Myanmar and Laos meet. With a borderline stretching 4060 km, the particular geographic position and complex surroundings make Yunnan the forward position of anti-drug battle. The fight against narcotics has become one of the major tasks for the local government. Police in Yunnan Province cracked 22,946 drug-related cases, arrested 25,728 criminal suspects, and seized 10.75 tons of narcotics of various types in 2005. Kunming Forced Narcotics Rehabilitation Centre is the largest one in China. It has treated 80 thousand heavy drug addicts since 1989.
 
China’s first anti-drug department was founded in Yunnan Public Security College (former name of Yunnan Police Officer Academy) in January, 2002. Since then, Yunnan Police Officer Academy has helped Myanmar train five groups of anti-drug policemen.

麻醉药品是指连续使用后易产生身体依赖性、能成瘾癖的药品, 包括鸦片、海洛因、甲基苯丙胺(“冰毒”)、吗啡、大麻、可卡因以及国家管制的其他能够使人形成瘾癖的麻醉药品和精神药品。一般来说,毒品具有以下共同特征:
        1、有一种不可抗拒的力量强制性地使吸食者连续使用该药,并且不择手段地去获得它;
        2、连续使用有加大剂量的趋势;
        3、对该药产生精神依赖性及躯体依赖性,断药后产生戒断症状;
        4、对个人、家庭、社会都会产生危害性结果。
 
毒品危害人民健康,滋生犯罪和腐败,破坏可持续发展,危及国家安全和世界和平。因此,对一切毒品违法犯罪活动必须严加禁绝。毒品祸国殃民。在旧中国,毒品曾给中华民族带来深重灾难。1949年中华人民共和国成立后,中国政府领导人民开展了声势浩大的禁毒斗争,在短短三年时间里,一举禁绝了为患百年的鸦片烟毒,创造了举世公认的奇迹。面对新的毒品问题,中国政府以对国家、民族、人民和全人类高度负责的态度,坚持严厉禁毒的立场,采取一切必要措施,尽最大努力禁绝毒品,造福人民。
 
多年来,中国政府以“禁绝毒品”为根本目标,制定并实施了一系列严厉禁毒的方针、政策和措施,坚持禁吸、禁贩、禁种、禁制,控制非法供应和防止滥用并重,禁止和打击一切从事毒品违法犯罪活动。1991年至1999年,中国禁毒执法机关共破获毒品违法犯罪案件80余万起,缴获海洛因39.67吨,鸦片16.894吨,大麻15.079吨,甲基苯丙胺23.375吨。但中国面临的毒品形势依然十分严峻,中国的毒品问题仍呈发展蔓延之势,并形成了毒品来源多元化、毒品滥用多样化的局面。一些制毒活动开始向中国内地和海外转移。近年来,娱乐场所摇头丸、K粉等新型毒品的销售和滥用有不断增多的趋势。
 
禁毒的关键在于唤起民众。中国把提高全民禁毒意识作为一项治本之策和战略任务,在全体国民中广泛深入地开展毒品预防教育。据国家禁毒委员会公布的数字,截至2004年,中国现有吸毒人员79.1万,其中,35岁以下青少年占70%。青少年正在成为“摇头丸”、“冰毒”、K粉等新型毒品的受害者。我们把预防青少年吸毒作为禁毒工作的基础工程。对青少年立足于教育和保护,采取各种有力措施,组织、协调政府有关部门和各种社会组织做好预防工作,教育青少年珍爱生命,拒绝毒品。把禁毒教育正式纳入中小学德育教育教学大纲,11岁至17岁的青少年必须接受禁毒教育。
 
位于中国西南部的云南省,毗邻“金三角”毒源地,与缅甸、老挝、越南三国接壤,边境线长达4,060公里。特殊的地理位置和复杂的周边环境,使云南省长期处于禁毒斗争的最前沿,禁毒斗争成为当地政府的一项主要任务。2005年,云南警方破获毒品案件22,946起,抓获毒品犯罪嫌疑人25,728名,缴获各类毒品10.75吨。目前,昆明市戒毒所已成为中国规模最大的综合戒毒中心,自1989年以来,已成功为近8万人次吸毒者治疗康复。
 
云南省公安高等专科学校(云南警官学院前身)禁毒系于2002年1月正式成立,被称为“中国禁毒第一系”。2002年至今,云南警官学院已先后对五批缅甸禁毒执法官员进行了培训。
